TERMS AND CONDITIONS

By entering Mountain Culture Beer Co.’s ‘Win a Royal Caribbean Holiday’ competition (the “Competition”), you are agreeing to the following Terms and Conditions:


GENERAL

  1. The Promoter (‘the Promoter’) of this Competition is Mountain Culture Brewing Company (ABN 92 624 018 999) of 35 David Rd, Emu Plains, NSW 2750. 

  2. Information on how to enter and prizes forms part of the Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.

  3. To the extent of any inconsistency between these Terms and Conditions and any other reference to this Competition, these Terms and Conditions will prevail.


WHO CAN ENTER?

  1. The Competition is open to all Australian residents who are aged 18 years or older. The competition excludes employees (and their immediate families) of the Promoter and all companies and agencies associated with this Competition ("Entrants"). Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.

  2. Entrants into this Competition must be 18 years of age as at the date of entry in order to be eligible to enter the Competition.

  3. The Promoter reserves the right to request winners to provide proof of identity, proof of residency in order to claim a prize. Requiring proof of identification and residency considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot or will not provide suitable proof (as determined by the Promoter, acting reasonably), the winner will forfeit the prize in whole and no substitute will be offered.

COMPETITION PERIOD

  1. The Competition commences on 07:00AM AEDT, Wednesday 29 October 2025 and concludes on 11:59PM AEDT, Tuesday, 9 December 2025 (the Competition Period”). Entries must be received by the Promoter prior to the Competition close date and time, in order to be valid.

  2. The Promoter accepts no responsibility for any late, lost or misdirected entries including online messages not received by the Promoter or delays in the delivery of the message due to technical disruptions, network congestions or for any other reason. Entries via automatic computer generation and not attributable to a valid individual are invalid and will not be accepted.

HOW TO ENTER

  1. To enter, Entrants must undertake all of the following steps, during the relevant Competition Period:

  • Purchase a case of Mountain Culture Status Quo at a Liquor Legends Store. 

  • Scan the QR code on the product package and visit the competition entry page here.   

  • At the competition entry page, you submit an online entry by completing the entry form (including your full name, email address, date of birth, postcode)

  • Provide an answer to the question: “For your chance to win a

  • Royal Caribbean family cruise getaway, if you could holiday with anyone,

  • who would it be and what would you get up to?” (the “Competition Question”), and then

  • Submit the fully completed entry form. 

  1. All entries once made, immediately become the property of the Promoter. 

  2. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these Terms and Conditions.

  3. If there is a dispute as to the identity of an Entrant, the Promoter shall, in its sole discretion, determine the identity of the Entrant.

  4. All entries shall be deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the Entrant.

  5. The Promoter takes no responsibility should an Entrant not have internet access permitting access to and use of the Instagram page. 

  6. Any entry that is made on behalf of an Entrant by a third party will be invalid, unless the Entrant requires the assistance of a third party to enter due to a genuine disability preventing the Entrant from making the entry him or herself.

  7. The Promoter reserves the right to disqualify any Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s decision is final and the Promoter will not enter into correspondence with any Entrant regarding the Competition or any aspect of it.

  8. Incomplete or indecipherable entries will be deemed invalid at the sole discretion of the Promoter.

 

NUMBER OF ENTRIES PERMITTED

  1. Entrants are entitled to one entry per person, in accordance with the entry requirements. 

DRAW

  1. There will be one (1) cruise prize winner selected in this promotion. The Promotor will judge all valid entries and select one (1) winner at {Mountain Culture Brewing Company of 35 David Rd, Emu Plains, NSW 2750} by Thursday, 11 December 2025. 

  2. The Promoter reserves the right at its sole discretion to draw additional reserve entries in the draw (and record them in order), in the event that an invalid entry is drawn or the Entrant drawn is ineligible.

  3. The Winners will be contacted via email by prizewinner.au@rcclapac.com within 5 working days of the winner draw with instructions on how to redeem their prize. 

  4. This Competition is a game of skill. The most creative and original answers will determine the winners.

  5. Should an Entrant’s contact details change during the Competition Period, it is the Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.


PRIZE

  1. There is a total of one (1) prize winner. The Prize includes a Royal Caribbean 7 to 9-night South Pacific cruise for up to (4) guests (including at least one person aged 18 or over) in a Balcony quad stateroom category 3D, departing from Brisbane or Sydney during the 2025-2026 summer season. Eligible sailing dates for the prize are listed below and are subject to availability at time of prize redemption. 

  2. Total Prize pool is valued at up to AUD$5,599.00 based on a Balcony quad stateroom category 3D on Voyager of the Seas’ 30 January 2026 sailing, published price as at 5 August 2025. All prices stated are in Australian dollars, represent the recommended retail price (RRP), include GST and are to the best knowledge, information and belief of the Promoter correct at time of printing.

  1. The cruise Prize is valid for four (4) guests, with at least one (1) guest 18 years of age or older. During the entire duration of a cruise Prize, a nominated parent / guardian must accompany any person under 18 years of age. All four guests must travel together. Any additional passengers are subject to the prevailing standard fare for the selected cruise date at the time of making the booking. 

  2. The best valid entry will be awarded a complimentary Cruise Certificate valid until 28 March 2026 to be redeemed on one (1) of the following options subject to availability:

  1. The prize value is based on the quad Balcony Stateroom grade cabin and any upgrades are unavailable. Prizes are not transferrable to any other ship, cruise or date than that which is specified above. 

  2.  The prize includes:

  • Complimentary onboard experiences and activities which may include (subject to availability, age, height and weight restrictions and terms & conditions) FlowRider® surf simulator, RipCord® by iFLY® (complimentary when at port and on Anthem only), North Star® (complimentary when at port and on Anthem only), SeaPlex® including bumper cars and roller-skating (Anthem only), rock-climbing wall, sports court, adults-only solarium, fitness centre, poolside movies, The Perfect Storm®  waterslide duo (Voyager only), Theatre entertainment, award-winning Adventure Ocean® Youth Programme (kids club); and 

  • Complimentary food and beverage venues (breakfast, lunch and dinner plus snacks, a la cart dining, pizza and soft serve ice cream).   • On selected sailings, complimentary ‘The Wiggles’ themed onboard events (including dance class, story time, main show, disco party, or treasure hunt). 

  1. The winner and their travelling companion/s are responsible for all other expenses not listed above including but not limited to: any other flights, travel or onboard costs/expenditure, pre or post cruise accommodation, spending money, meals (other than those specified), drinks (other than those specified), mini-bar, incidentals, laundry, room service, phone calls, gratuities, optional activities and excursions, freight, excess baggage, ground transport, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, service charges, passports, visas, travel insurance, and all transfers, including travel costs to and from their closest capital city airport if the winner is from a regional area. The winner is responsible for ensuring that they and their travelling companion(s) are fit to travel and have received appropriate immunisations, insurance, and/or health checks prior to taking the prize.

  2. It is the Winner’s and their travelling companion’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas which meet the requirements of immigration and other government authorities at the destinations. Any fines, penalties, payments of expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller.

  3. Where relevant, it is the Winner’s and their travel companion’s personal responsibility to ensure that they have valid travel and health documentation. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner and their travel companions. The Promoter and the Prize Provider makes no representation as to the safety, conditions or other issues that may exist at any destination.

  4. All Prize travel will be subject to the carrier’s General Conditions of Carriage. The Promoters and carrier make no representations as to the safety, conditions or other issues that may exist at any destination. By entering this Competition, and by collecting the Prize, the Winner acknowledges and accepts that driving, travel and any other activities comprising the Prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses.

  5. The Promoter/Prize Provider strongly recommends that all Winners take out travel insurance and consult the www.smarttraveller.gov.au website prior to travelling.

  6. Unless otherwise expressly stated, Prize values are based upon the recommended retail prices as at 5 August 2025. The Prize Provider accepts no responsibility for change in Prize value between now and the ultimate Prize redemption date.

  7. Independent financial advice should be sought as tax implications may arise as a result of accepting the Prize.

  8. Prizes cannot be transferred, exchanged or redeemed for cash.

  9. All Entrants agree that if they Win the Prize, they will not, and their companions will not, sell or otherwise provide their story and / or photographs to any media or other organisation, including the internet. Photographs will be allowed only at the discretion of the Prize Provider.

  10. In the event that a prize, or part of a prize, is unavailable (for any reason beyond the Promoter's reasonable control), the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal or greater recommended retail value and/or specification, subject to any written directions from the various lottery departments.

  11. Winner/s acknowledge and accept that some prizes that form part of the prize pool are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may take place.

  12. It is a condition of accepting the prize that the winner and their companions (if any) must comply with all the conditions of use of the prize and the prize supplier’s requirements (as applicable).

  13. Caution: any attempt to deliberately damage or undermine the legitimate operation of this competition, may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the promoter reserves the right to seek damages to the fullest extent permitted by law.

  14. If any prize remains unclaimed by Thursday 18th December 2025, the Promoter may conduct a further draw at the same time and place as the original prize draw as necessary on Friday, 19 December, 2025, in order to distribute any prize that remains unclaimed by that date, subject however to all reference to any relevant State and Territory regulations. Winners (if any) will be notified in writing within one (2) business days of this draw.

PERSONAL INFORMATION

  1. By entering this Promotion, entrants agree to the use of their names, photographs and likeness for promotional/advertising purposes, and agree to make themselves reasonably available for this purpose.  Any copyright associated with an entry will be owned by Royal Caribbean. 

  2. Royal Caribbean collects and holds personal information provided by entrants for the purposes of administering this Promotion and for future Royal Caribbean promotional purposes.  All personal information provided by entrants will be held by Royal Caribbean and will not be provided to third parties unless otherwise specifically set out.  Under the Privacy Act 1993, entrants have the right to access and correct their personal information.  Please refer to Royal Caribbean’s Privacy Policy.

LIABILITY AND RELEASE

  1. Except for any liability that cannot be excluded by law, the Promoter, its related entities and each of their respective officers, employees, contractors and agents, exclude all liability (including for negligence) for any personal injury and any loss or damage (including to persons or property and including consequential loss and loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any electronic or human error which may occur in the administration of the Competition; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or an Entrant; (f) entry into and/or participation in the Competition and/or (g) the prize and/or redemption of the prize. This condition does not affect, and is not intended to affect, any rights an Entrant may have as a consumer, which cannot be excluded under applicable consumer protection laws. 

  2. To the extent permitted by law, the Promoter makes no representations or warranties as to the quality, suitability or merchantability of a prize.

FURTHER TERMS AND CONDITIONS

  1. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

  2. If for any reason this Competition is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion take any action that may be available, and (without limitation) to cancel, terminate, modify or suspend the competition, subject to any direction given under State or other applicable Regulation or Law.

  3.
